Terms of Service – Peoples & Pets Pharmacy

These Terms of Service (“Terms”) govern your use of the Peoples & Pets Pharmacy website, mobile applications, and related pharmacy services. By accessing or using our services, you agree to these Terms.

Services

We provide prescription services for both humans and animals, subject to applicable federal and Michigan state pharmacy laws.

 Eligibility

You must be at least 18 years old to use our services. For minors, a parent/guardian must authorize use.

Patient Counseling

Peoples & Pets Pharmacy will offer counseling to all patients (or their caregivers) upon the initial dispensing of a new prescription, in compliance with Michigan Administrative Code R 338.4772.

Counseling Methods

Counseling may be conducted in person, via telephone, or through secure video consultation for online/mail-order prescriptions.

Patient Rights

Patients have the right to request counseling at any time. Refusals will be documented in the pharmacy system.

Scope of Counseling

Counseling will include drug name, dosage, route, intended use, side effects, interactions, and storage instructions.

Prescription Policy

• All prescriptions must be valid, issued by a licensed prescriber.

• We may verify prescriptions with your provider before dispensing.

• We reserve the right to refuse service if prescriptions are invalid, unsafe, or non-compliant.

Payment and Insurance

You agree to pay all charges for services and products not covered by insurance. Insurance claims will be submitted on your behalf when applicable.

Controlled Substances

Peoples & Pets Pharmacy complies with federal DEA regulations and Michigan Automated Prescription System (MAPS) reporting requirements for all controlled substances.

Verification

Photo identification and prescriber verification will be required prior to dispensing controlled substances.

Limits

Controlled prescriptions will be dispensed only within federal and state refill and day supply limits.

Security

Controlled substances are stored in accordance with DEA security requirements.

 

Policy Statement

Peoples & Pets Pharmacy may communicate via SMS text and email regarding prescriptions, refills, and health-related services with patient consent.

Consent Requirement

Patients must provide written or electronic consent prior to receiving electronic communications.

Opt-Out

Patients may revoke consent at any time by contacting the pharmacy or using unsubscribe mechanisms provided in communications.

Privacy Assurance

All communications will comply with HIPAA privacy and security requirements.

Shipping Policy

Orders will be shipped within 1–2 business days via licensed carriers. Tracking numbers will be provided to customers.

Delivery Liability

Peoples & Pets Pharmacy is not responsible for carrier delays, but will assist patients in resolving delivery issues.

 

Refund Policy

By law, prescription medications cannot be returned or refunded once dispensed. Refunds may be issued for non-prescription items in unopened condition within 14 days.

Damaged/Incorrect Orders

If an order arrives damaged or incorrect, the pharmacy will promptly investigate and issue replacements when appropriate.

User Responsibilities

• Provide accurate, complete information for yourself and your pets.

• Notify us immediately of changes to health status, insurance, or contact details.

• Use medications only as prescribed.

Limitation of Liability

Peoples & Pets Pharmacy is not liable for misuse of prescriptions, delays caused by shipping carriers, or unauthorized use of your account.

Complaints and Grievances

Peoples & Pets Pharmacy maintains a process for patients to submit complaints or grievances regarding services, safety, or care.

Submission

Complaints may be submitted in person, by phone, by mail, or electronically via the pharmacy website.

Response

All complaints will be acknowledged within 5 business days and investigated promptly.

Regulatory Reporting

Patients may also contact the Michigan Board of Pharmacy for unresolved complaints.

Dispute Resolution

These Terms are governed by the laws of the State of Michigan. Any disputes shall be resolved in the state or federal courts of Livingston County, Michigan.

Changes

We may update these Terms at any time, with notice posted on our website

Mobile Terms of Service

The People and Pets Pharmacy mobile message service (the "Service") is operated by People and Pets Pharmacy (“People and Pets Pharmacy”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to People and Pets Pharmacy’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of People and Pets Pharmacy through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with People and Pets Pharmacy. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18774627461 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other People and Pets Pharmacy mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
